CUSTOMTRI TERMS OF SERVICE Last Updated: May 5, 2026 These Terms of Service ("Terms") govern your access to and use of the website located at customtri.com (the "Site") and the training plan services offered by CustomTRI LLC, an Idaho limited liability company ("CustomTRI," "we," "us," or "our"). By creating an account, accessing the Site, or purchasing a training plan, you agree to be bound by these Terms in full. If you do not agree to these Terms, do not use the Site or purchase any services. --- 1. ELIGIBILITY You must be at least 18 years of age to create an account or purchase a training plan. By using the Site you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. Our services are intended for individuals who are physically capable of engaging in endurance sports training. By using our services you represent that you are in suitable physical condition to undertake the training activities described in your plan, or that you have consulted with a qualified physician who has cleared you to do so. --- 2. ACCOUNTS To access the questionnaire and purchase a training plan you must create a free account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at customplans2026@gmail.com if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are used in any way that harms CustomTRI or other users. --- 3. THE SERVICE CustomTRI uses artificial intelligence to generate personalized triathlon training plans based on the information you provide through our questionnaire. The plans are generated automatically without human review by a certified triathlon coach or licensed healthcare professional. Our service is limited to generating a training plan document based on your self-reported data. We do not provide coaching, medical advice, nutritional counseling, physical therapy, or any other professional service. The training plan you receive is a starting point for your training, not a substitute for professional guidance. We strongly recommend that you review your plan with a certified triathlon coach before beginning training. --- 4. ACCURACY OF INFORMATION The quality and appropriateness of your training plan depends entirely on the accuracy of the information you provide in the questionnaire. You are solely responsible for providing accurate, honest, and complete answers. CustomTRI is not responsible for training plans that are inappropriate, ineffective, or potentially harmful as a result of inaccurate, incomplete, or misleading information you provided. Once you submit the questionnaire and complete your purchase, your answers are final and cannot be changed. We do not regenerate plans based on corrected or updated information. --- 5. PAYMENT AND PRICING Training plans are offered at the following one-time prices: Sprint Triathlon Plan -- $9.00 USD Olympic Triathlon Plan -- $17.00 USD Half Ironman Plan -- $27.00 USD Full Ironman Plan -- $39.00 USD All prices are in US dollars. Payment is processed securely through Stripe. By completing a purchase you authorize us to charge your payment method for the applicable plan price. --- 6. ALL SALES ARE FINAL -- NO REFUND POLICY ALL PURCHASES ARE FINAL. WE DO NOT OFFER REFUNDS, EXCHANGES, CREDITS, OR MODIFICATIONS UNDER ANY CIRCUMSTANCES. This no-refund policy applies without exception, including but not limited to: - Dissatisfaction with the training plan content - Changes in your race schedule or race cancellation - Injury or illness preventing you from training - Failure to read or understand the plan before purchase - Technical issues on your end preventing download or access - Dissatisfaction with the AI-generated nature of the plan - Answers submitted in error or that you wish to change By completing your purchase you confirm that you have reviewed the sample plan on our Site, you understand the AI-generated nature of the service, and you agree that no refund will be issued under any circumstances. If you have questions about what to expect from your plan, review the sample plan at customtri.com before purchasing. --- 7. MEDICAL DISCLAIMER AND ASSUMPTION OF RISK TRIATHLON TRAINING INVOLVES SIGNIFICANT PHYSICAL EXERTION AND CARRIES INHERENT RISKS INCLUDING BUT NOT LIMITED TO CARDIOVASCULAR STRAIN, MUSCULOSKELETAL INJURY, DEHYDRATION, AND IN EXTREME CASES DEATH. CustomTRI training plans are generated based solely on your self-reported questionnaire responses. They do not account for any physical health conditions, mental health conditions, chronic illnesses, disabilities, injuries, cardiovascular conditions, or other medical limitations you may have, whether disclosed or undisclosed. CONSULT YOUR PHYSICIAN BEFORE BEGINNING THIS OR ANY TRAINING PROGRAM. This recommendation applies to all athletes regardless of fitness level or experience. By purchasing and using a CustomTRI training plan you: a) Acknowledge that you have read and understood this medical disclaimer b) Represent that you have consulted with or have knowingly chosen not to consult with a licensed healthcare provider c) Voluntarily assume all risks associated with triathlon training and racing, including the risk of serious injury or death d) Release, indemnify, and hold harmless CustomTRI LLC and its owners, operators, and agents from any and all claims, damages, losses, or expenses arising from your use of any CustomTRI training plan --- 8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CUSTOMTRI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF INCOME, OR ANY OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE TRAINING PLAN THAT IS THE SUBJECT OF THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions our liability is limited to the maximum extent permitted by law. --- 9. NO WARRANTY OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT YOUR TRAINING PLAN WILL BE ACCURATE, COMPLETE, SUITABLE FOR YOUR FITNESS LEVEL, OR THAT FOLLOWING THE PLAN WILL RESULT IN ANY PARTICULAR ATHLETIC OUTCOME, RACE COMPLETION, OR IMPROVEMENT IN PERFORMANCE. We make no representation that any training plan generated by CustomTRI has been reviewed or endorsed by a certified triathlon coach, sports medicine professional, or any other qualified expert. --- 10. INTELLECTUAL PROPERTY The Site and all of its content including but not limited to text, graphics, logos, design, code, and training plan formats are the property of CustomTRI LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission. Your personalized training plan is licensed to you for personal use only. You may not resell, redistribute, or share your plan for commercial purposes. --- 11. PROHIBITED CONDUCT You agree not to: - Use the Site for any unlawful purpose - Attempt to gain unauthorized access to any part of the Site or our systems - Submit false or misleading information in the questionnaire - Create multiple accounts to circumvent any restriction - Use automated tools to scrape, copy, or reproduce content from the Site - Resell or redistribute training plans generated by CustomTRI --- 12. PRIVACY Your use of the Site is also governed by our Privacy Policy, available at customtri.com/privacy-policy, which is incorporated into these Terms by reference. --- 13. MODIFICATIONS TO THE SERVICE We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services. We may update these Terms from time to time. When we do we will update the Last Updated date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We will notify you of material changes by email if you have an account with us. --- 14. GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your use of our services shall first be attempted to be resolved through good faith negotiation. If negotiation fails within 30 days, disputes shall be resolved through binding arbitration in Ada County, Idaho, administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. --- 15. SEVERABILITY If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. --- 16. ENTIRE AGREEMENT These Terms, together with our Privacy Policy, constitute the entire agreement between you and CustomTRI LLC regarding your use of the Site and our services, and supersede all prior agreements and understandings. --- 17.
